App Terms of Service

These terms are a contract between you and eBrain Technology Group GmbH ("eBrainGo", "we", "us") for the eBrainGo mobile app and related services (the "Service"). By creating an account or using the app you agree to them. If you do not agree, do not use the Service.

Our Privacy Policy explains how we handle personal data and forms part of these terms.

1. Who the Service is for

The Service is event software provided to the attendees, exhibitors and staff of events run by our customers (the "organisers"). You must be at least 18 years old, or the age of majority where you live, and use the Service in a professional capacity. If you are using the Service on behalf of a company, you confirm you are authorised to bind it to these terms.

2. Accounts

You can only sign in if an organiser has enrolled your email address for an event. The organiser decides which events you can access and which role you have (attendee, exhibitor, front-desk staff).
You must give accurate information, keep your password confidential and tell us at info@ebraingo.com if you believe your account has been used without permission. You are responsible for activity under your account.
One person, one account. Do not share accounts or impersonate anyone.
You can delete your account at any time from the Account screen in the app (section 10).

3. The organiser’s role

Organisers control the content of their events: the programme, speakers, venue information, logistics, surveys, announcements and who may attend. They may moderate the event feed and chat, restrict posting, remove participants from their event, and show you their own privacy notice when you enter the event. Questions about an event’s content or your registration go to the organiser.

4. Licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the eBrainGo app on a mobile device you own or control, for the events you are enrolled in, in accordance with these terms and the rules of the app store you downloaded it from. You may not copy, modify, distribute, sell, rent, reverse-engineer or decompile the app except where the law allows it, remove any proprietary notices, or use the app to build a competing service.

5. Acceptable use

You must not:

harass, threaten, defame or discriminate against anyone, or post content that is unlawful, obscene, hateful, violent, sexually explicit or otherwise objectionable;
send spam, unsolicited advertising or mass messages;
impersonate another person or organisation, or misrepresent your affiliation;
upload malware or content that infringes someone else’s rights;
collect, scrape or export other participants’ data except through the lead-capture feature described in section 8, and only with their consent;
interfere with the Service, probe its security, or access data or accounts you are not authorised to access;
use the Service in breach of applicable law, including export-control and sanctions law.

6. Your content

"Content" means anything you post or send through the Service: chat messages, voice notes, photos, videos, documents, posts, comments, survey answers, questions to the Alia assistant and lead notes.

You keep ownership of your content. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and transmit it, solely to operate the Service for the event (including showing it to other participants, delivering notifications about it, generating Alia answers from it, and moderating it).
You are responsible for your content and confirm you have the rights to share it.
When you delete your account, your profile, posts, comments and likes are removed. Messages you sent in chats remain visible to the other participants of those chats, attributed to "Deleted User", so that their conversation history stays intact.

7. Objectionable content, reporting and blocking

We have zero tolerance for objectionable content and abusive behaviour.

You can report a post, hide it and block a user from the feed directly in the app; you can report and block a user from chat. Blocked users cannot contact you.
We review reports and remove content or eject the responsible user within 24 hours of a report. Organisers can additionally remove content and participants from their events.
Repeated or serious breaches lead to suspension or termination of the account (section 11).

8. Exhibitor lead capture

Exhibitors may use the app to scan attendee badges or enter contacts and to record lead details. If you use this feature:

you are the controller of the lead records you create and are responsible for collecting them lawfully, in particular for obtaining the attendee’s consent to be contacted and for honouring the attendee’s rights;
you may use lead data only for following up on the event and in accordance with the organiser’s rules and applicable law;
where the organiser uses a third-party badge service such as ExpoLeads, your use of that service is subject to its own terms;
leads captured offline are stored on your device until they sync; they are lost if you delete your account before syncing.

Lead records are held by you and the organiser and are not deleted when the attendee deletes their eBrainGo account.

9. The Alia assistant

Alia answers questions about your event using a language model and your event’s data, and can add sessions to your schedule when you confirm. Answers may be inaccurate or incomplete — verify times, rooms and travel details in the programme. Your questions are processed by our AI provider in Germany as described in the Privacy Policy. Do not rely on Alia for medical, legal, safety or financial decisions.

10. Deleting your account

You can delete your account at any time from the Account screen in the app (Delete account) or by emailing info@ebraingo.com from the address on your account. Deletion signs you out everywhere immediately and completes in the background within 30 days at most. What is deleted and what is kept is described at https://ebraingo.com/delete-account. Some accounts cannot be deleted automatically (platform staff; the only remaining member of an active organiser account) — the app explains why and offers an email contact.

11. Suspension and termination

We may suspend or terminate your access, with or without notice, if you breach these terms, if the law requires it, or to protect the Service or its users. Organisers may remove you from their events at any time. Termination ends your licence to use the app; sections that by their nature should survive (content licence for retained messages, disclaimers, limitation of liability, governing law) survive.

12. Notifications

The app sends push and in-app notifications about your events: messages, comments and mentions, session changes, travel and logistics updates, reminders and organiser announcements. You can switch any category off under Notification preferences in the app or revoke the permission in your phone settings. Organisers may use announcements only for operational, event-related information, never for marketing.

13. Third-party services

Parts of the Service rely on services provided by others under their own terms: Apple and Google app stores and operating-system features (push notifications, speech recognition, calendar), Google Maps for the venue and route previews, and badge services such as ExpoLeads chosen by organisers. We are not responsible for those services or for content provided by organisers, exhibitors or other participants.

14. Intellectual property

The app, its design, software and trademarks belong to us or our licensors. Event content belongs to the respective organiser or its licensors. Except for the licence in section 4 and the rights you keep in your own content, no rights are granted to you.

15. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that the Service will be uninterrupted, error-free or secure, or that event information (times, rooms, travel details) is accurate — it is supplied by organisers. Nothing in these terms limits rights you have as a consumer under mandatory law.

16. Limitation of liability

To the extent permitted by applicable law, we are liable for damages only in accordance with the limitations set out in these Terms. We are fully liable for damages arising from injury to life, body or health, and for damages caused by intentional or grossly negligent conduct. In cases of slight negligence, our liability is limited to the foreseeable, typically occurring damage, provided that we have breached a material contractual obligation. Liability under mandatory statutory provisions remains unaffected. Any exclusion or limitation of liability also applies to our employees, representatives and agents to the extent permitted by law.

17. Indemnity

If you use the Service on behalf of a business, you shall indemnify us against third-party claims and reasonable costs arising from your content, your use of the lead-capture feature, or your material breach of these Terms, to the extent that you are legally responsible for the underlying conduct. You must promptly notify us of any such claim and reasonably cooperate with us in its defense. This obligation does not apply to the extent that the claim results from our own breach, negligence, or unlawful conduct.

18. Additional terms for the Apple App Store

If you downloaded the app from the Apple App Store: these terms are between you and us only, not Apple, and Apple is not responsible for the app or its content; the licence in section 4 is limited to Apple-branded devices you own or control, as permitted by the App Store Terms of Service; Apple has no obligation to provide maintenance or support; if the app fails to conform to any applicable warranty you may notify Apple, which will refund the purchase price (if any) — Apple has no other warranty obligation; we, not Apple, are responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance and consumer protection claims, and for the investigation, defence and settlement of any third-party intellectual property infringement claim; you represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country and are not on any U.S. Government list of prohibited or restricted parties; you must comply with applicable third-party terms when using the app; Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

19. Changes to these terms

We may update these terms. We will post the new version here with a new effective date and, for material changes, notify you in the app or by email before they take effect. Continuing to use the Service after that date means you accept the new terms.

20. Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules. For disputes with business customers, the courts of Berlin, Germany, shall have exclusive jurisdiction, to the extent permitted by applicable law. Consumers may rely on any mandatory protections afforded to them under the laws of their country of residence and may bring proceedings before the courts having jurisdiction under applicable consumer protection laws.
